Utländska företag med filial i Sverige är bokföringsskyldiga enligt bokföringslagen. Filialen ska ha en egen bokföring som är skild från det utländska företagets bokföring. 

Förra året sa riksdagen ja till en lagändring som innebär att utländska filialer i Sverige är bokföringsskyldiga för sin svenska verksamhet enligt bokföringslagen. Det betyder samtidigt att de omfattas av ett straffansvar och kan dömas för bokföringsbrott enligt svensk lag om de inte uppfyller bokföringsskyldigheten.

Tanken med regelförändringen var att skapa lika förutsättningar att driva verksamhet i Sverige, oavsett om företaget är svenskt eller om det är en filial till ett utländskt bolag. Det gäller även fysiska personer som är bosatta utomlands med driver verksamhet i Sverige.

På Bokföringsnämndens webb finns information om vad som gäller för olika företagsformer, och nu har myndigheten utökat informationen rörande bokföring och redovisning för filialer i Sverige.

Bokföringsnämnden skriver bland annat att filialen ska tillämpa bokföringslagen och Bokföringsnämndens normgivning, vilket innebär att:

• Alla affärshändelser ska bokföras löpande.
• Det ska finnas verifikationer till alla bokföringsposter.
• Räkenskapsinformation ska arkiveras i ordnat skick och på betryggande och överskådligt sätt i Sverige i sju år.
• Årsbokslut eller årsredovisning ska upprättas för varje räkenskapsår.

När det gäller vilket språk som ska användas skriver Bokföringsnämnden att räkenskapsinformationen som filialen själv upprättar ska vara på svenska, danska, norska eller engelska. Skatteverket kan besluta om tillstånd att använda annat språk.

Redovisningsvalutan i filialen ska vara svenska kronor. I utländska företag som motsvarar ett svenskt aktiebolag eller en svensk ekonomisk förening kan redovisningsvalutan i filialen vara euro.
